In late April, the state took action to pull the operating license from a nursing home and assisted living facility in Aurora, Illinois, after multiple reports of abuse. One of the reports included the death of a 57-year-old schizophrenic man with a history of violence. The resident apparently died of a heart attack while assaulting his roommate, who had called for help more than 20 minutes before a staff member came to investigate.</p>
<p>In another example, the LaSalle County Nursing Home now has four lawsuits pending against it stemming from claims that a male resident sexually assaulted as many as 12 female residents at the facility. One of the assaults was so violent that it broke the victim&#8217;s pelvis. The male patient has a history of sexual assault and has since been moved to a psychiatric facility. The families of four of the victims have filed lawsuits against the nursing home, claiming the facility failed to properly supervise its residents, among other claims.</p>
<p>These types of horror stories do little to make families feel safe leaving the care of their loved ones in the hands of a nursing home. But unfortunately, for some families nursing homes are the only viable option they have for caring for ill, elderly or disabled family members.</p>
<p>The Illinois Nursing Home Care Act</p>
<p>Under the Illinois Nursing Home Care Act, nursing home residents are guaranteed certain rights while staying in a long-term care facility, including the right to be free from abuse and neglect.</p>
<p>Under the Act, abuse is defined as &#8220;any physical or mental injury or sexual assault inflicted on a resident other than by accidental means.&#8221; Some examples of nursing home abuse include:<br />
- Physical abuse, including hitting, slapping or being overly rough when handling residents<br />
- Emotional abuse, including threatening and degrading residents, yelling at them and/or using swear words<br />
- Sexual abuse, including unwanted touching and rape</p>
<p>The Act defines neglect as &#8220;a failure to provide adequate medical or personal care or maintenance when that failure results in physical or mental injury to a resident or the deterioration of a resident&#8217;s physical or mental condition.&#8221; Some examples of nursing home neglect include:<br />
- Failing to monitor and supervise residents, including their physical and mental health<br />
- Failing to seek emergency or other medical attention when needed<br />
- Failing to provide residents with necessary medications<br />
- Failing to keep residents and their environment clean, sanitary and safe<br />
- Failing to correctly position and move incapacitated residents to prevent bed sores and ulcers<br />
- Failing to keep residents properly hydrated and fed</p>
<p>In most cases, nursing home abuse and neglect is perpetrated by those who work in these facilities and who are responsible for providing day-to-day care to the residents. In some cases, the abuse may be caused by other residents living at the facility.</p>
<p>There is a chronic understaffing problem in nursing homes &#8212; not just in Illinois, but across the country &#8212; that makes it difficult for these facilities to provide the level of care that each resident deserves. It also makes it difficult for the nursing home staff to properly monitor the residents, which may create the opportunity for resident-on-resident abuse.</p>
<p>Regardless of the staffing limitations, nursing homes still owe a legal duty to their residents to provide them with a safe, caring environment that is free from abuse and neglect.</p>
<p>Warning Signs of Abuse and Neglect: Bed Sores, Injuries from Falling and Poor Hygiene</p>
<p>Victims of nursing home abuse and neglect often are helpless to stop the abuse. In some cases, the victims may be incapacitated and not able to communicate what has happened to them. For this reason, it can be very difficult to detect and prevent nursing home abuse. In fact, it is estimated that for every report of abuse made nationally, another 12 to 13 cases go unreported.</p>
<p>While Illinois law makes it mandatory for certain individuals, including physicians, nurses and nursing home staff members, to report suspected abuse to the state Department of Public Health, this does not mean the report is always made. For this reason, it is important that family members stay alert for any signs or symptoms their loved ones may exhibit of abuse or neglect.</p>
<p>Some of the potential signs of abuse or neglect include:<br />
- Unexplained broken bones, abrasions or other bruising or injury<br />
- Behavioral changes, including depression and anxiety<br />
- Hostility towards a specific staff member or other nursing home employee<br />

- Soiled bedding and/or clothing<br />
- Bed sores<br />
- Unclean physical appearance<br />
- Unexplained weight loss, malnourishment and/or dehydration<br />

Also today, two Miami-area residents were sentenced to prison for their participation in a separate HIV infusion Medicare fraud scheme.<br />
Modesto de la Vega, 59, and his wife, Victoria de la Vega, 59, pleaded guilty before U.S. District Court Judge Adalberto Jordan to one count of conspiracy to defraud the United States, to cause submission of false claims to Medicare, and to pay health care kickbacks; one count of conspiracy to commit health care fraud; and three counts of submitting false claims, as charged in a March 2010 indictment. At sentencing, scheduled for Nov. 5, 2010, Modesto and Victoria de la Vega each face a maximum penalty of five years in prison for the conspiracy to defraud the United States count and each false claims count, and 10 years in prison for the health care fraud conspiracy count.</p>
<p>According to plea documents, Modesto de la Vega was an owner and operator of T&amp;R Rehabilitation Professional Corp., a Miami clinic that purported to provide expensive injection and infusion treatments to patients with HIV. Victoria de la Vega was an office assistant at T&amp;R. Modesto de la Vega admitted at his plea hearing that he agreed with his co-defendants and others to enlist patient recruiters and patients, among others, into a scheme to defraud Medicare. Modesto and Victoria de la Vega admitted that they knew the patients at T&amp;R did not need and/or did not receive the purported services, and that it would be necessary to pay kickbacks and bribes to the patients so that T&amp;R could bill the Medicare program for the HIV infusion services that were not medically necessary and/or were not provided.</p>
<p>The defendants admitted that from approximately January 2003, through approximately July 2005, they and their co-defendants caused T&amp;R to submit fraudulent claims to the Medicare program in the amount of approximately $13.7 million. Medicare paid approximately $4.1 million of these fraudulent claims.<br />
In a separate and unrelated case, two Miami-area residents were sentenced today by U.S. District Judge Ursulla Ungaro in the Southern District of Florida for their participation in a similar HIV infusion Medicare fraud scheme. Keith Earnest Humes, a patient recruiter for a fraudulent HIV/AIDS infusion clinic known as Tendercare Medical Center Inc., was sentenced to 84 months in prison and three years of supervised release, and was ordered to pay restitution jointly and severally with co-defendants in the amount of $539,485. Lawrence Edward Humes, also a patient recruiter for Tendercare, was sentenced to 33 months in prison and three years of supervised release, and was ordered to pay restitution jointly and severally with co-defendants in the amount of $222,967. In addition, based on the court&#8217;s consideration of relevant conduct, Keith Humes was ordered to pay further restitution in the amount of $346,889.</p>
<p>According to court documents, Keith Humes and Lawrence Humes admitted that they conspired with each other and other individuals to defraud Medicare by submitting false claims for injection and infusion treatments that were medically unnecessary and that in most instances were not provided. Keith Humes and Lawrence Humes paid kickbacks to beneficiaries in return for their Medicare numbers and signatures, which Tendercare used to submit the false claims. Between January 2005 and December 2007, Tendercare submitted approximately $5.8 million in false and fraudulent claims to Medicare for treatments that were medically unnecessary or never provided. Medicare paid Tendercare approximately $2.7 million.<br />
Today&#8217;s guilty pleas and sentences were announced by Assistant Attorney General Lanny A. Breuer of the Criminal Division; U.S. Attorney Wifredo A. Ferrer of the Southern District of Florida; John V. Gillies , Special Agent-in-Charge of the FBI&#8217;s Miami field office; and Special Agent-in-Charge Christopher Dennis of the HHS Office of Inspector General (HHS-OIG), Office of Investigations Miami office.<br />
The cases were prosecuted by attorneys from the Criminal Division&#8217;s Fraud Section, including Trial Attorneys N. Nathan Dimock, Joseph Beemsterboer, Charles D. Reed, former Trial Attorney Michael Padula, former Fraud Section Assistant Chief John S. (Jay) Darden and former Fraud Section Special Trial Attorney Martha Talley, on detail from HHS-OIG. The cases were investigated by the FBI and HHS-OIG and were brought as part of the Medicare Fraud Strike Force, supervised by the Criminal Division&#8217;s Fraud Section and the U.S. Attorney&#8217;s Office for the Southern District of Florida.</p>
<p>Since its inception in March 2007, the Medicare Fraud Strike Force operations in seven districts have obtained indictments of more than 810 individuals and organizations that collectively have billed the Medicare program for more than $1.85 billion. In addition, HHS&#8217;s Centers for Medicare and Medicaid Services, working in conjunction with the HHS-OIG, are taking steps to increase accountability and decrease the presence of fraudulent providers.</p>

			<content:encoded><![CDATA[<p>I recently gave a presentation to about 70 females on the subject of fat loss and the common methods we use to attempt to rid ourselves of excess body fat. During my research for the talk, I unearthed a large amount of material that supports my belief that most of the world&#8217;s population are being misled in their quest for a slim, but healthy body, that so many of us crave!</p>
<p>&#13;</p>
<p>Does it feel like the whole idea of fat loss is only possible for the genetically gifted&#8230;</p>
<p>&#13;</p>
<p>Are you searching for the quick fix that will trim away body fat overnight?</p>
<p>&#13;</p>
<p>Or are you still waiting for our &#8220;trusted&#8221; pharmaceutical companies to produce the ultimate weight loss pill that will solve worldwide obesity problems&#8230;</p>
<p>&#13;</p>
<p>Sharing some of the following facts and myths with you is not going to be easy for you to stomach, I suspect that you&#8217;ll be shocked, dismayed or maybe you&#8217;ll feel that none of what I tell you is true.</p>
<p>&#13;</p>
<p>In fact I am fairly sure you&#8217;ll dispute much of what I report, so I ask you to check my sources, read for yourself the studies that I cite. You&#8217;ll be as shocked as my audience when you really do discover the truth about fat loss!</p>
<p>&#13;</p>
<p>Myth 1 &#8211; Skipping meals and snacks is OK if I want to lose fat! Do you skip breakfast, the odd lunch, or maybe you don&#8217;t eat at all for a whole day, because you &#8220;don&#8217;t feel hungry&#8221;?</p>
<p>&#13;</p>
<p>PLEASE DON&#8217;T!!</p>
<p>&#13;</p>
<p>There is nothing worse for your metabolism than irregular feedings.</p>
<p>&#13;</p>
<p>Eating 6 meals a day compared to just 2 meals a day of the SAME caloric value total for the day, will result in more fat loss!</p>
<p>&#13;</p>
<p>Check out study no.1 to discover why eating every few hours is ESSENTIAL for fat loss!</p>
<p>&#13;</p>
<p>Myth 2 &#8211; A calorie is a calorie</p>
<p>&#13;</p>
<p>Unfortunately NOT.</p>
<p>&#13;</p>
<p>Eating a diet of refined carbs and low fat will actually make you fatter, than a diet of low carb, high fat of the same caloric value!</p>
<p>&#13;</p>
<p>If you think about it we have been told by the FDA in the US to reduce the amount of Fat in our diet and replace it with carbs like bread and pasta. The food pyramid clearly showed this!</p>
<p>&#13;</p>
<p>Sadly it is all those refined carbs that have been adding to our waist line and not the fats.</p>
<p>&#13;</p>
<p>Study no.2, proves that a diet high in fat actually resulted in MORE fat loss!</p>
<p>&#13;</p>
<p>Myth 3 &#8211; You must only train in the &#8220;fat burning zone&#8221; to lose fat!</p>
<p>&#13;</p>
<p>Probably the biggest myth in the world of health and fitness today, and one that drew the most gasps and head shaking in my audience!</p>
<p>&#13;</p>
<p>The fat burning zone DOES exist BUT, it is NOT an effective workout strategy for overall fat loss.</p>
<p>&#13;</p>
<p>How can that be?</p>
<p>&#13;</p>
<p>To be honest you don&#8217;t need to read the studies to prove this, you can see for yourself in the gym. How many people do you see going to the gym week after week for months on end, doing their fat-burning zone workouts, BUT never actually changing shape?</p>
<p>&#13;</p>
<p>The nail in the coffin of your fat burning zone workouts is crystal clear study no.3 comparing a &#8216;diet only&#8217; group to a &#8216;diet and exercise&#8217; group. The exercise consisting of a 45 minute &#8220;fat burning zone&#8221; routine, 5 days a week for 12 weeks.</p>
<p>&#13;</p>
<p>The abstract from this study states: Results indicate that moderate aerobic exercise training during a 12-week period has no discernible effects on body composition.</p>
<p>&#13;</p>
<p>i.e. fat burning zone workouts do nothing for losing body fat!!</p>
<p>&#13;</p>
<p>WOW!</p>
<p>&#13;</p>
<p>Myth 4 &#8211; Calorie counters on machines are useful for fat loss&#8230;</p>
<p>&#13;</p>
<p>We&#8217;ve all done it, waiting for the calorie counter on the treadmill or cross trainer to tick by 400 or 500 calories burnt during your workout. We can then feel all virtuous as we tuck into our post workout coffee and chocolate muffin, safe in the knowledge we have &#8220;earned&#8221; it.</p>
<p>&#13;</p>
<p>Unfortunately, calories burned during your workouts are not significant when you want to lose fat!</p>
<p>&#13;</p>
<p>Study no.4 compared endurance style workouts to higher intensity interval training where the number of total calories burned during the workout, was over twice as much for the endurance group than the intervals group.</p>
<p>&#13;</p>
<p>You would think that the endurance group would logically lose more fat given that they have burned more calories in total? However the intervals group lost NINE times more fat than the endurance group!</p>
<p>&#13;</p>
<p>Those calorie counters on your exercise bike are really worthless, my advice, cover them up!</p>
<p>&#13;</p>
<p>Myth 5 &#8211; Crunches will get rid of your belly fat!</p>
<p>&#13;</p>
<p>How many crunches do you do each day? 10, 20&#8230; maybe 50, 100&#8230; or maybe more?</p>
<p>&#13;</p>
<p>Any self respecting fitness professional will tell you that &#8220;spot reduction&#8221; doesn&#8217;t work! If it did, all the people doing 100 crunches a day would be walking around with a perfect SIX PACK, but flabby butt and thighs! It just doesn&#8217;t work like that!</p>
<p>&#13;</p>
<p>So quit wasting your time and effort on this ineffective exercise and have a go at doing some of the more effective methods instead&#8230;</p>
<p>&#13;</p>
<p>THREE truly effective ways of getting rid of body fat</p>
<p>&#13;</p>
<p>1. Drop the refined carbs from your diet. Eat more high quality proteins and unrefined carbs in the form of fresh fruit and vegetables.    2. Do some short, sharp and very effective interval workouts.    3. Get your trainer to show you some intensive ALL BODY resistance workouts, utilising large muscle groups as much as possible!</p>
<p>&#13;</p>
<p>Each of these methods will achieve the necessary result of boosting your &#8220;basal metabolic rate&#8221;, this is your 24/7 fat burning system in your body.</p>
<p>&#13;</p>
<p>Utilise all 3 methods and fat will literally melt away!</p>
<p>&#13;</p>
<p>12 weeks is a relatively short time period in your lifetime, and this is all it took for Claire to drop over 5% in body fat, and drop 2 dress sizes utilising the same three methods of fat loss. With renewed confidence in her body and her structural health too, she is now embarking on a new sporting passion of rock climbing&#8230;.</p>

<p>The foods that help you lose fat are easy to digest, which in turn strengthens and speeds up your metabolism. As your metabolism gets stronger your body is better able to shed stored fat.</p>
<p>The best foods are the obvious &#8211; fresh fruits and vegetables. These foods not only support your digestion, but can help strengthen it over time. This can in turn eliminate the need for expensive digestive enzymes.</p>
<p>Eat fresh fruits in the morning when your body is naturally cleansing itself. This cleansing process involves your liver eliminating toxins and metabolizing fats. When this function is supported, your liver gets more fat burning efficiency.</p>
<p>Assist this fat burning process with a squeeze of lemon or lime juice in your water. This helps clear waste as it is released from the fat cells. Be sure to drink six to eight glasses of water throughout the day.</p>
<p>To be sure you get in a sufficient amount of fat burning veggies, start your noon and evening meals with a fresh, green salad. Use a dressing made of olive oil and apple cider vinegar for more fat loss effectiveness.</p>
<p>The raw vegetables in this salad will help strengthen your digestion over time. A stronger digestions leads to a higher metabolism, which burns fat quicker.</p>
<p>Add two servings of fresh, lightly steamed vegetables to these meals, also. These are easy to digest allowing more enzymes so your body can more efficiently digest any protein eaten in your meals. Having these extra servings of veggies ensures you are getting the nutrition your body and digestive processes need.</p>
<p>Be sure to eat lean, fresh, organic proteins throughout your day. If you don&#8217;t want to take time to calculate how much you need in grams, follow the simple palm rule; eat a protein portion that is about the size of your palm.</p>
<p>Lean proteins help your body build muscle which burns more calories. They contribute to the lean, cut look of fitness experts, which is why many fat loss routines include eating them anywhere from three to five times per day, depending upon your weight.</p>
<p>Good proteins to choose from include lean, organic beef, organic poultry, free range, organic eggs, fresh halibut, tuna, salmon, legumes and every kind of sprout. But there is a fat loss food that is not only a source of protein, but has other enhanced fat loss and health benefits.</p>
<p>Lean, organic beef is an excellent fat loss food. Organic is the key, however. Organic beef contains Omega 3&#8242;s, Vitamin E and CLA, which is not available in non-organic meats.</p>
<p>These three components protect your body from various cancers, free radicals which can cause premature aging, reduce abdominal fat, and reduces the incidence of diseases including heart disease and diabetes.</p>
<p>You can find organic beef, along with your organic vegetables and fruits, at your local health food market. The price may be higher, but keep in mind the portion you should be eating.</p>
<p>Proteins for fat loss can easily turn into proteins that pack on pounds when you eat too much of it. In fact, this is one of the main reasons for weight gain &#8211; eating too much protein. So keep your portions controlled.</p>
<p>One more fat loss food is yogurt. Yogurt adds good bacteria to your intestinal tract. This strengthens digestion which, as we now know, speeds metabolism. Yogurt is also an excellent source of protein which can be used as a low calorie, healthy protein snack in between meals. Be sure to get yogurt that doesn&#8217;t contain artificial ingredients and sugar including high fructose corn syrup.</p>
<p>Don&#8217;t forget to avoid junk foods, sodas and other sugary treats. These foods add fat, trigger cravings and make your fat loss efforts void.</p>
<p>Try making as many meals with fat loss foods as you can. Focus on these foods as the main portion of your diet and fat loss will come easier and stay more permanently.</p>
